1. This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
2. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name baggagesharing.com ('Website'), including the related mobile site and mobile application (hereinafter referred to as 'Platform').
3. The Platform is owned by Paravolver Futura Private Limited, a company incorporated under the Companies Act, 1956 with its registered office at C-30, 7th FLOOR, BRAHMA APARTMENTS New Delhi SECTOR-7, New Delhi, India (hereinafter referred to as ‘Platform Owner’, 'we', 'us', 'our').
4. You must be 18 years of age or older and legally capable of entering into binding agreements in accordance with applicable law in order to access and use the Platform and Services. By using the Platform, you represent and warrant that you satisfy these eligibility requirements. You further agree to act lawfully and to provide true, accurate, current and complete information when registering or using the Platform and Services. Any misrepresentation of information or unlawful use of the Platform shall constitute a breach of these Terms of Use and may result in suspension or termination of your account and/or access to the Services.
5. Baggage Share is a facilitator only and does not operate as a transporter or carrier. Accordingly, we are not responsible for:
   • The safety, delivery, or condition of any baggage or items.
   • The accuracy or truthfulness of information provided by any Traveler or User.
   • The legal compliance of items being transported through the Platform.
6. Travelers using the Platform agree and undertake to:
   • Hold a valid, unexpired train or flight ticket for the relevant journey.
   • Refuse to carry any illegal, suspicious, or unsafe items.
   • Inspect baggage when deemed necessary for safety or compliance.
   • Comply with all applicable transport, customs, and security laws and regulations.
   • Ensure delivery of baggage or items as agreed with the User.
   Failure to adhere to these obligations shall be deemed a material breach of these Terms of Use and may result in suspension or termination of account access in addition to legal consequences under applicable law.
7. Users of the Platform agree and undertake to:
   • Not send prohibited, dangerous, or illegal items under any applicable laws or airline/train regulations.
   • Disclose baggage contents truthfully and not misrepresent or conceal the nature of the items.
   • Provide valid, accurate, and complete contact and delivery details to ensure successful handover and receipt.
   • Acknowledge that the Traveler has the right to refuse or reject baggage if it is unsafe, suspicious, or non-compliant.
   Any breach of these obligations shall constitute a violation of these Terms of Use and may result in suspension, termination of services, and/or legal action under applicable law.
8. You acknowledge and agree that:
   • The Platform Owner may levy service fees for providing matching, facilitation, or related services through the Platform.
   • All payments in respect of such fees or charges shall be made solely through the authorized payment gateways integrated on the Platform. The Platform Owner shall not be liable for any loss, error, or fraud arising from the use of unauthorized payment methods.
   • The Platform Owner reserves the right, at its sole discretion, to modify, amend, or revise the fees or charges applicable to the Services, provided that reasonable notice of such changes is displayed on the Platform. Continued use of the Platform or Services after such notice shall constitute your acceptance of the revised fees or charges.
9. When accessing or using the Platform and Services, you agree and undertake that you shall not:
   • Provide any false, inaccurate, or misleading information in any form or manner.
   • Engage in any unlawful, exploitative, or prohibited activity under applicable law or these Terms.
   • Commit or attempt any act of impersonation, identity fraud, or misrepresentation of your association with any person or entity.
   • Undertake any activity that may interfere with, disrupt, or impair the security, functionality, or performance of the Platform or its associated systems.
10. Users and Travelers are strictly prohibited from transporting, sending, or requesting the carriage of the following items:
    • Drugs, alcohol, or tobacco (unless expressly permitted by applicable law).
    • Weapons, explosives, or hazardous materials.
    • Perishable goods or live animals.
    • Stolen, counterfeit, or otherwise unlawful goods.
    • Any item restricted under applicable law, transport regulations, or carrier guidelines.
    Any violation of this clause may result in suspension or termination of your account and may further attract legal action under applicable law.
11. Baggage Share does not provide any insurance coverage for baggage, items, or transactions facilitated through the Platform. Users and Travelers expressly acknowledge and agree that they assume all risks associated with the use of the Platform, including but not limited to loss, theft, damage, delay, or non-delivery of baggage or items. Users and Travelers are strongly encouraged to obtain independent insurance coverage for baggage or items being transported.
12. The Platform Owner reserves the right, at its sole discretion, to suspend or terminate your account and/or access to the Services, without prior notice, under any of the following circumstances:
    • Violation or breach of these Terms of Use or any applicable policies.
    • Engagement in suspicious, fraudulent, or illegal activity.
    • Where suspension or termination is required under applicable law, regulation, or by order of a competent authority.
    Upon termination, you shall lose access to the Platform and Services, and no compensation, reimbursement, or damages shall be payable by the Platform Owner in respect thereof.
13. Any disputes, disagreements, or claims arising between Users and Travelers in relation to baggage, delivery, payments, or any other matter must be resolved independently by the concerned parties. Baggage Share may, at its sole discretion, provide informal assistance in facilitating communication or resolution. However, Baggage Share shall bear no legal responsibility, liability, or obligation for the outcome of such disputes.
14. Your use of the Platform and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with the Platform Owner and these terms and conditions including the policies constitute Your binding obligations, with Platform Owner. These Terms of Use relate to your use of our website, goods (as applicable) or services (as applicable) (collectively, 'Services'). Any terms and conditions proposed by You which are in addition to or which conflict with these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect. These Terms of Use can be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms of Use to stay informed of updates.
15. For the purpose of these Terms of Use, wherever the context so requires ‘you’, 'your' or ‘user’ shall mean any natural or legal person who has agreed to become a user/buyer on the Platform.
16. ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.
17. The use of Platform and/or availing of our Services is subject to the following Terms of Use:
    1. To access and use the Services, you agree to provide true, accurate and complete information to us during and after registration, and you shall be responsible for all acts done through the use of your registered account on the Platform.
    2. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this website or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
    3. Your use of our Services and the Platform is solely and entirely at your own risk and discretion for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your requirements.
    4. The contents of the Platform and the Services are proprietary to us and are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. The contents includes and is not limited to the design, layout, look and graphics.
    5. You acknowledge that unauthorized use of the Platform and/or the Services may lead to action against you as per these Terms of Use and/or applicable laws
    6. You agree to pay us the charges associated with availing the Services.
    7. You agree not to use the Platform and/ or Services for any purpose that is unlawful, illegal or forbidden by these Terms, or Indian or local laws that might apply to you.
    8. You agree and acknowledge that website and the Services may contain links to other third party websites. On accessing these links, you will be governed by the terms of use, privacy policy and such other policies of such third party websites. These links are provided for your convenience for provide further information.
    9. You understand that upon initiating a transaction for availing the Services you are entering into a legally binding and enforceable contract with the Platform Owner for the Services.
    10. You shall indemnify and hold harmless Platform Owner, its affiliates, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.
    11. Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.
    12. These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India.
    13. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi and Delhi.
